UNIVERSAL LUXURY COACHES, LLC
On October 5, 2004, the State of Florida, Office of Financial Regulation (“OFR”) filed a complaint in the Circuit Court for the Eighteenth Judicial Circuit in Seminole County against Universal Luxury Coaches, LLC (“ULC”), Case No. 04-CA-2130-16-W, charging it with violations of the Florida securities laws and seeking to enjoin its violations of these laws in connection with a fraudulent scheme to offer and sell unregistered securities. While ULC purported to engage in the sale of timeshare interests in luxury motor coaches, ULC, through its various members of the sales force, obtained approximately $7 million from approximately 150 investors as a result of material misrepresentations or omissions in connection with the sale of unregistered securities. The Court entered a temporary injunction against ULC and its members, shareholders, directors, officers, agents, servants, employees and attorneys and those in active concert or participation with any of the foregoing from, inter alia, employing any device, scheme or artifice to defraud and selling unregistered securities.
By the same order dated October 5, 2004, the Court also appointed Gary D. Lipson as Receiver over ULC. On September 15, 2016, Burton W. Wiand was appointed as substitute Receiver of ULC due to the passing of Mr. Lipson.

On October 28, 2016, the Receiver filed a Motion To (1) Approve Determinations of Claims, (2) Approve Plan of Distribution and a First Interim Distribution, and (3) Establish Objection Procedure (the “Motion”). A copy of this Motion is available below. Each individual or entity who filed a claim (“Claimant”) should receive a letter from the Receiver identifying his/her claim number. The recommended determination of each claim is set forth in the Exhibits attached to the Motion and is addressed in the body of the Motion.
